II.         Status overview

Land reserved for indigenous people is the land for special purposes or uses demarcated by the government to protect the livelihood of indigenous people and promote indigenous administration. To ensure the rights and interests of indigenous peoples and promote the fair use of land reserved for indigenous peoples, according to Article 37 of the Slopeland Conservation and Utilization Act and the Regulations on Development and Management of the Lands Reserved for Indigenous Peoples, after guiding indigenous peoples to apply for registration of the cultivation right on farmland, the agriculture right on forest land, and the superficies right on construction land respectively, all related entities shall help them acquire the ownership of such land for free after their self-operation or self-use of such land for five consecutive years. In response to the resource development and the planning and management of land reserved for indigenous people at present, the “Inventory of Resource Utilization of Land Reserved for Indigenous Peoples” was specifically implemented in 1995. The online land management information system for land reserved for indigenous peoples has been constructed with the completed inventory items including “cadastral data, land ownership, and land utilization status” to provide a reference for development and strategy making. This Implementation Plan is thus established in response to the desperate need for registration of land reserved for indigenous peoples under the guidance of municipal (county/city) governments and local township (town/city/district) offices to ensure the land rights of indigenous peoples.

III.         Objectives

1.          To impartially and fairly allocate land for indigenous peoples and encourage local governments to engage in restoration of rights of land reserved for indigenous people to maintain the livelihood of indigenous people, achieve the policy of land reserved for indigenous peoples and fair use of national land, in order not to harm national spatial protection and violate environmental conservation.

2.          To subsidize the hiring of temporary professionals at municipal (county/city) governments, totaling 56, to assist with the land administration for land reserved for indigenous peoples in local township (town/city/district) offices, with services covering assistance for the application for registration of land reserved for indigenous peoples, completion of related forms and documents, and file updating, in order to resolve the under-staff problem in local township (town/city/district) offices and thereby complete the restoration of the rights over land reserved for indigenous peoples.

3.          To organize training for management of land reserved for indigenous peoples for officers and clerks of all levels engaging in the management of land reserved for indigenous peoples to get more familiar with the various professional competencies required for reviewing related applications, service attitudes, methods, basic legal concept and literacy, and services for citizens.

4.          To organize exchange of opinions on the policies, laws, and regulations in relation to land reserved for indigenous peoples and subsidize local township (town/city/district) offices to print opinion exchange data (handbooks) to exchange opinions through various exchange activities for indigenous peoples to acknowledge the information, laws, and regulations in relation to the restoration of rights of land reserved for indigenous peoples; and to subsidize various training activities, seminars, and forums.

5.          To collate the cadastral data of the revision survey of land division of land reserved for indigenous peoples through local (county/city) governments and local township (town/city/district) offices, commission land administration offices to implement the survey for boundary verification, the revision survey of land division, and registration of land reserved for indigenous peoples to resolve and clarify the ownership, territory, and boundary among lands reserved for indigenous peoples, settle the disputes over and unfair allocation of land reserved for indigenous peoples, and organize land ownership cadastral data, hoping that indigenous peoples can value and make fair development and utilization of land reserved for indigenous peoples.

6.          To update the change data in the online land management information system for land reserved for indigenous peoples by local township (town/city/district) offices under the supervision of local (county/city) governments; implement ownership transfer and creation of other rights, lease and utilization management, land ownership termination and waiver, and various matters in relation to land reserved for indigenous peoples.

IV.     Scope of Plan

This Implementation Plan shall cover 30 mountain indigenous townships (districts) including the Wulai District, and 25 plain indigenous townships (towns/cities/districts) within the territory of land reserved for indigenous peoples within the jurisdiction of four municipal cities, including New Taipei City, and eight counties including Hsinchu County.
