Seasonal Rituals Holidays are Extended to Three Days for the Inheritance of Indigenous Peoples' Culture

The Enactment of Holidays and Festivals promulgated by the President on May 28 has been effective since May 30. The Annual Rituals is a traditional festival for indigenous peoples and a national holiday, which is clearly stipulated in the law. For indigenous peoples to arrange to return to their hometowns and participate in rituals, the current one-day holiday has been extended to three days. Indigenous peoples may take this holiday separately or consecutively so they can fully participate in ritual events.

To implement indigenous peoples' rights as protected by the Enactment, and considering that some government agencies, units, and businesses would encounter special circumstances such as shift work, job rotations, on-call shifts, or have a larger proportion of employees who are indigenous peoples, the Council of Indigenous Peoples therefore calls on businesses to adjust internal systems as early as possible to avoid operations from being affected or violations of the Labor Standards Act due to manpower deployment issues.

The Enactment stipulates that indigenous peoples can choose to take three days off according to the tribe's seasonal rituals schedule. The holidays only apply to individuals with legal indigenous status. When applying for leave, employees must provide their household registration transcript or other documents proving their status. Indigenous peoples can also choose the tribe's seasonal rituals of their spouse or parents when applying for leave.

A buffer period is not specified in the regulations. The Council of Indigenous Peoples has announced the seasonal rituals holiday periods for 2025 in accordance with the law.
