Control Yuan Criticizes Delay in Amending the Indigenous Peoples Employment Rights Protection Act: CIP Will Continue Coordinating with Legislative Yuan to Expedite Passage

In response to reports that the Control Yuan has issued a corrective measure over delays in amending the Indigenous Peoples Employment Rights Protection Act, which has affected public interests, the Council of Indigenous Peoples (CIP) stated that following Judicial Yuan Interpretation No. 810, the council promptly initiated the amendment process. As a transitional measure, the CIP formulated the Interim Guidelines for Adjusting Employment Compensation Payments for Indigenous Peoples in April 2022, allowing cases in which the employment compensation amount exceeded the procurement amount to be approved for downward adjustment to the procurement level—thus preventing excessive burdens on individual cases and fulfilling the requirements of the judicial interpretation.

The CIP explained that the draft amendment to the Indigenous Peoples Employment Rights Protection Act introduces an appropriate adjustment mechanism to address the concern that a uniform calculation method for compensation may result in overly harsh outcomes. The Executive Yuan submitted the draft to the Legislative Yuan for deliberation on September 28, 2023, and resubmitted it on February 15, 2024, after the prior legislative session expired without review. The CIP affirmed that it will continue to coordinate with the Legislative Yuan to ensure the amendment process is completed as soon as possible.
