Asia Cement Corporation Land Mining Controversy in Xiulin Township: Council of Indigenous Peoples Assists Tribe Members in Obtaining Land Ownership – Rent Income to be Redirected to the Indigenous Community

To resolve the long-standing dispute over Asia Cement Corporation's lease of indigenous land in Xiulin Township and to ensure the land rights of indigenous people, the Council of Indigenous Peoples issued the Plan for the Restoration of Indigenous Reserve Land Rights in the Xinchengshan Mine Area of Xiulin Township, Hualien County, yesterday on May 3. The plan covers 550 parcels of land, totaling approximately 448 hectares, and aims to assist indigenous people in obtaining land ownership. The rent payments that Asia Cement Corporation owes to the Xiulin Township Office will be redirected to the indigenous community. The plan will be implemented from May 6, 2024, and is expected to be completed within two years.

In the fifth meeting of the Indigenous Historical Justice and Transitional Justice Committee in 2018, President Tsai Ing-wen instructed that an investigation team composed of tribes, the government, and Asia Cement Corporation be formed. The Ministry of Economic Affairs held three tripartite meetings in 2018. Then-Minister Shen Jong-chin personally attended the meetings on behalf of tribes. From 2018 to 2020, the investigation team held a total of seven meetings, and from 2020 to 2021, Minister without Portfolio Lin Wan-i, Council of Indigenous Peoples Minister Icyang Parod, the Ministry of Economic Affairs, and the Council of Indigenous Peoples conducted 22 consultations with the tribe and Asia Cement Corporation. Finally, on February 9, 2022, the Executive Yuan released the "Investigation Report on Asia Cement Corporation's Lease of Indigenous Land in Xinchengshan Mine Area," which pointed out procedural flaws in the handling of land rights and leasing by the Hualien County Government and Xiulin Township Office. To mitigate the adverse effects on indigenous people, the government committed to fully communicating with the tribe and formulated the Plan for the Restoration of Indigenous Reserve Land Rights in the Mine Area.

Moreover, on February 12, 2022, Asia Cement Corporation carried out the tribal consultation and consent process, with 294 votes in favor and 45 against, fully respecting the tribe's right to self-determination. Subsequently, Asia Cement Corporation implemented the agreed-upon consultation items (a total of 21 items, such as electricity subsidies, house repair guarantees, sponsorship of cultural and educational events, emergency relief funds, and scholarships). Each year, the company contributes over NT$15 million to the tribe in an act of repatriation and justice for indigenous peoples.
